3. Counter-Notification Procedure

If you believe that the material removed or disabled as a result of a DMCA notice is not infringing, or that you have the legal right to post the material, you may file a counter-notification with our Copyright Agent. The counter-notification must include:

  • Your physical or electronic signature.
  • A description of the material that was removed or disabled and the location where it appeared before it was removed.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material.
  • Your name, address, telephone number, and email address.
  • A statement that you consent to the jurisdiction of the federal court in your district, or if you are outside of India, in the jurisdiction of the courts located in India, and that you will accept service of process from the person or entity who provided the original DMCA notice.

4. Repeat Infringers

In accordance with the DMCA and other applicable laws, GBProWa.com will terminate, under appropriate circumstances, the accounts of users who are repeat infringers.
